Minister of Economy Gevorg Papoyan presented a new legislative initiative to parliament aimed at establishing regulations for the protection of consumer rights and aligning Armenian legislation more closely with EU standards.
The bill amending the Law on Protection of Consumer Interests was debated on Tuesday.
"When aligning with the directive on unfair terms in contracts with consumers, contracts concluded with consumers cannot include unfair conditions. These refer to terms that a consumer, acting in their own interest, would not have accepted if given the opportunity to participate in determining the contract’s terms," Papoyan said.
The bill also defines the types of unfair terms.
"It establishes the concepts of misleading advertising and comparative advertising, the circumstances under which advertising is considered misleading, and the permissible and impermissible cases of comparative advertising," the minister added.
Regarding contracts concluded remotely or outside business premises, the alignment with the consumer protection directive will introduce the institution of remote contracts and contracts concluded outside business premises.
"As a result of aligning with the directive, consumers will be protected by having the right to contact the manufacturer, seller, or service provider within a fixed period if a defect is discovered in a product, including digital content, in order to have the defect remedied," Papoyan said.
These regulations will apply to any contract concerning movable property, sharing data in electronic form, or other forms of interaction.
