YEREVAN, JANUARY 30, ARMENPRESS: The preliminary investigation of the criminal case initiated against the former Head of the RA Police General Department of Criminal Intelligence Service H. Tamamyan, the former Deputy Head of the Arabkir Division of Yerevan Police A. Poghosyan and the former Senior Investigator of the Department on Specially Important Cases of the General Investigation Department of the Police V. Khanzadyan on abuse of official duties was completed by the Special Investigation Service. The prosecutor who supervised the preliminary investigation of the criminal case confirmed the bill of indictment, press service of the General Prosecutor's Office reported.
According to the evidence obtained during the pretrial examination, H. Tamamyan kept from criminal liability Aram and Arthur Martirosyans who attempted to murder Hakob and Hovsep Hovhannisyans and S. Zargaradoghyan on November 5, 2009 in Gavar. Knowing who had committed the murder and where the instruments of crime were kept H. Tamamyan failed to check the information and to reveal the instruments of crime. H. Tamamyan broke the requirements of the Point 172 of the Police Order on Maintaining Confidentiality and destroyed the summary of the telephone conversation conducted during the preliminary investigation of the criminal case which included information confirming that Aram and Arthur Martirosyans had been related to the murder of Hakob and Hovsep Hovhannisyans and S. Zargaradoghyan committed on November 5, 2009 in Gavar.
Besides, H. Tamamyan organized and led the operative and intelligence operations carried out by the employees of the General Criminal Intelligence Department and Arabkir Police to reveal the murder of Kh. Mkrtchyan and cause of severe bodily injuries to A. Aharonyan and P. Grigoryan during the skirmish on May 12, 2010 in Komitas Avenue.
In particular, in order to keep V. Baghdasaryan from criminal liability and to present distorted evidence to the preliminary investigation body H. Tamamyan used his official position against the interests of the service that is he hid V. Baghdasaryan's participation in the commitment of the mentioned crime and did not take measures to reveal the real circumstances of Kh. Mkrtchyan's murder.
According to the evidence obtained during the preliminary investigation H. Tamamyan was charged according to the RA Criminal Code Article 308, parts 1 and 2, V. Khanzadyan and A. Poghosyan according to the Article 308, part 2. The criminal case was sent to the Court of First Instance of Kentron and Nork-Marash administrative districts.
The criminal case against two persons on Kh. Mkrtchyan's murder was sent to the Court in March, 2011. Vram Baghdasaryan was charged according to the RA Criminal Code Articles 104, part 2, points 6 and 10, 235, part 1 and 258, part 4 and David Sandaljyan according to the Article 38-258, part 4. On November 11, 2011 the Court of First Instance of Arabkir and Kanaker-Zeytun administrative districts sentenced them to imprisonment.
The part of the criminal case on the murder committed against Hakob and Hovsep Hovhannisyans and Spartak Zargaradoghyan was also sent to the Court in 2011. Arthur Martirosyan and Hrachya Petrosyan were charged according to the Articles 34-104, part 2, points 1 and 7 and 235, part 2. Aram Martirosyan was charged according to the Articles 34-104, part 2, points 1 and 7, 235, part 2 and 38-235, part 1. The trial is finished in the Court of First Instance of Gegharkunik Region and the phase of the court dispute began.
