Government proposes bill to streamline European Court compensation payments

The Armenian government’s Representative on International Legal Matters, Karen Andreasyan, presented a bill to lawmakers regarding procedures for fair compensation in accordance with European Court judgments.
The proposed amendments to the law On the Representative of Legal Matters would establish a new authority, enabling the government to regulate the process of paying fair compensation mandated by European Court judgments and decisions, while preventing technical issues related to paperwork.
“Paying the amount of fair compensation determined by the European Court’s judgments and decisions is an unequivocal obligation of the Republic of Armenia. However, it should be noted that, to receive fair compensation within the prescribed timeframe, applicants must submit the necessary documents, which in practice often presents certain challenges,” he said during the second reading in parliament.
Andreasyan noted that required documents are frequently submitted incompletely or at times when the Prime Minister’s Office is unable to ensure payment within the established deadline.
He also emphasized that Armenian legislation currently lacks clear legal regulation governing the payment of fair compensation.
“While fair compensation payments may have been made in practice to date, the absence of a legal basis has repeatedly caused various practical problems, highlighting the need for the proposed regulation,” Andreasyan said.
