Kocharyan’s immunity doesn’t cover pressed charges, argues prosecutor

YEREVAN, SEPTEMBER 12, ARMENPRESS. There are no grounds to release ex-president Robert Kocharyan free based on the Constitutional Court’s decision, Yerevan prosecutor Gevorg Baghdasaryan said at the first day of Kocharyan’s trial. Baghdasaryan was addressing Kocharyan’s motion whereby the ex-president is arguing that he must be released from pre-trial detention and the criminal prosecution should be suspended based on the recent CC decision.

The prosecutor requested the court to dismiss the motion.

“According to the Constitutional Court the consequences can theoretically arise in the event when during a usual court procedure it will be recorded that the former president is accused in the kind of actions and acts in regard to which he has immunity. Meaning, in the event when it will be connected to his status. In the given case in all situations, after all, the courts have recorded that the actions of which ex-president Robert Kocharyan is accused in do not stem from his status,” the prosecutor said.

“The charges pressed against Kocharyan aren’t related to his immunity and the actions he is accused in can not be viewed as actions stemming from a president’s status. Therefore there are no grounds to release Robert Kocharyan free based on the Constitutional Court’s decision,” Baghdasaryan added.
