Harutyun Injighulyan’s family discusses opportunity to apply to ECHR

YEREVAN, MARCH 17, ARMENPRESS: Family members of the Armenian captive in Azerbaijan Hakob Injighulyan consider legal mechanisms to apply to the European Court of Human Rights. Hakob Injighulyan’s brother Harutyun Injighulyan stated this in a conversation with the journalists. “Currently we discuss the question with our relatives having work experience in the legal field on what opportunities there are for presenting lawsuits to the European Court of Human Rights,” Harutyun Injighulyan said.

International law expert Ara Ghazaryan informed the media that Hakob Injighulyan’s parents can apply to ECHR on the basis of Article 8 of European Convention on Human Rights. The latter includes the right for reunification of a child and parents. And in such cases positive duty emerges at the states joined the Convention to provide the person with at least one direct communication between parents and son before transporting him to the third country. According to Ara Ghazaryan, they can apply to the European Court on that ground expecting legal position.

Hakob Injighulyan, born in 1991, at about 03:00 at night of August 7-8 during his service did not manage to orient in the territory and crossed the Karabakh-Azerbaijan border and appeared on the territory protected by the rival’s troops.On August 8 the Armenian Office of the International Committeeof theRed Cross applied to the ICRC Baku Office on the incident.
