M. Sargsyan’s suit against Azerbaijan will hear in ECHR on February 5

The delegation headed by the Prosecutor General of the Republic of Armenia, Representative of Armenia in ECHR Gevorg Kostanyan on January 19 will leave for Strasbourg to participate in the trial of “Sargsyan” and “Chiragov” cases appointed in the European Court of Human Rights. Deputy Prosecutor General Emil Babayan is among the members of the delegation. The councilor of Prosecutor General of the Republic of Armenia Kristine Melkonyan informed “Armenpress” that hearings on “Chiragov and others against Armenia” suit will commence in the Grand Chamber of ECHR on January 22. Citizens of Azerbaijan, six people of Kurd nationality turned to the ECHR for the reimbursement of property demand. At the course of the hearings Armenia will introduce itself as respondent, while Azerbaijan as the third side.

The European Court will hear the suit by the former resident of Gyulistan village of Shahumyan region in North Artsakh Minas Sargsyan against Azerbaijan on February 5. The first hearing on the suit of the citizen of the Republic of Armenia was held in September 2010. Minas Sargsyan introduced a suit on August 11 against the demolition of his house and forcible deportation from his own residence, violation of law on disposing his property and the right for using it, violation of the right to personal and family life, elimination of a number of Armenian cemeteries in Azerbaijan, forcible deportation of Armenians from their residences, discrimination because of national and religious affiliation, as well as the Government's inaction on the violence facts towards Armenians. At the course of the hearings of that suit Azerbaijan will introduce itself as a respondent; Armenia will be the third side.

Decisions made by European Chamber of the Supreme Court come into force after publication, are not subjected to appealing and are obligatory for the sides.
