Parliament adopts bill banning eviction from sole shelter
YEREVAN, OCTOBER 25, ARMENPRESS. The Parliament adopted the bill on “Compulsory Enforcement of Judicial Acts”, under which individuals failing to meet obligations won’t be evicted from their only shelter – regardless what obligation the person has violated.
102 lawmakers voted in favor of the bill.
The main goal of the bill is ensuring that no one becomes homeless – that no one pays off for failed obligations on behalf of their right of residence.
The only exception for this rule are cases when an individual has pawned his only apartment, which means the individual has voluntarily risked his right of residence. Exceptions also include cases when individuals have alimony obligations or has to compensate for criminally inflicting damages to someone’s health, life.
On one hand the Constitution of Armenia and International documents define the right to property, while on the other hand it is planned to define limitations to this right.
The law on Compulsory Enforcement includes a list of properties which cannot be confiscated.
