European Court completely satisfies Armenia Government’s demands on Perinçek case

YEREVAN, OCTOBER 15, ARMENPRESS. The European Court has announced its decision on Perinçek v. Switzerland case on October 15, 2015. Armenia was represented as a third party in Perinçek v. Switzerland case. Being a third party, the Republic of Armenia expected to exclude formulations casting doubts on the Armenian Genocide.

“Armenpress” was informed by Prosecutor General's Office of the Republic of Armenia that the European Court noted in today’s decision that it was not the Court to decide whether massacres and deportations committed against the Armenians in 1915 by the Ottoman Empire could be named as genocide from the point of view of meaning attributed to genocide by international right. Furthermore, the Grand Chamber of the European Court of Human Rights stated that the Court did not have the jurisdiction of making legal statements referring the issue independent of the angle it was made from.

 The decision of the Court also states that the Armenians have right to respect for their dignity and the dignity of their ancestors, also in terms of the identity of the Armenian community which was hurt in the result of the genocide.

Finally, in connection to Perinçek’s case, the European Court established that bringing Perinçek to responsibility did not completely contradict European Court’s right to precedents but that there had been wrongful execution of Swiss law in  Perinçek’s case. That is to say, criminalizing the denial of the Armenian Genocide and bringing to responsibility for the latter was considered as legitimate which had to be implemented exceptionally within the European Convention.

As a result, all the demands of the Government of Armenia were satisfied by the European Court.
